My boyfriend recently discovered that one of the managers in his store frequently adjusts employees’ time clocks to reflect a 30 minute lunch break if they clock out for less than 30 minutes.
It seems to me that this is illegal, and the correct course of action would be to discipline the employees that are not taking the full 30 minutes in another way.
Is it illegal to adjust the time clocks in this manner? And, is it *legally required* that people take a 30 minute break for 8 hours of work? Could the company get in trouble if it was seen that people were not taking the full time entitled to them if they did it voluntarily?
Thank you!
This is taking place in NJ, if that helps. I’m getting the impression that required break laws vary from state to state.
