legal questions for wrongfull termination and others?
I was recently fired from what I think might be a business that does some things illegally.
The day I was fired, my manager was going through some stress…she had scheduled only one person for the evening shift on accident, and was having other problems that were causing her to be in a bad mood as she always is.
I was also stressed out, admittedly I had been working 7 days a week 5-7 hours a day, attending college, and am engaged. (worrying about money for the wedding next year.)
That day I had a Panic Attack around 2pm(after my manager had gone home), I have never had a panic attack before, and this one was bad. My fingers were cramped up, my arms, chest, and face were numb.
I had to call an ambulance to come get me, and take me to the hospital. The hospital had a 4 hour wait so I had my mother come get me and stay with me until I calmed down.
The next day, when I went to get my truck from the store (which had been left over night due to the panic attack.) I come in to find out I had been fired.
Her excuse was that I am "scaring customers", and cursing employees.
Now I "KNOW" that there is only one employee that has a problem with me at this job, and I work with him maybe 4 times a month.
I am one of the very few people that work at subway that has never had a customer complaint…The manager…the assistant manager…the night manager…have all had customer complaints.
Yet without warning, I am fired the day after I have a panic attack…now I do admit that I was no-t acting in a polite and decent way this day and the night before, but I was no worse than the manager or assistant manager act on a daily basis.
There are also other things, such as the time clock we use is the cash register, making it impossible for us to clock in sometimes until after we had been there for a while.
What is the solution for this? They go in and manually change our clock in hours to what is showed on the schedule. Which is also wrong because Almost every employee comes in early and has to start working early due to her scheduling to little people.
(I have worked here for the better part of 3 years, I have quit for 3-4 month periods twice in this 3 years due to the anger I had been building up from the constant verbal harrasment, sexual harasment from many employees,(which even after telling my manager, it continued.)
The last straw that is making me consider legal action is the last paycheck I recieved was missing some time…now it was only 15 minutes, but I wrote it on the schedule because I came in 15 minutes early, and my manager came to my truck and had me go to the bank to get change for the store.)
Earlier when I started working there, I had 3 paychecks in a row that I had to go and gett them to change because the general manager left off hours.
Now I dont know if I have a case, but I would like to know what other people think.
So I have nothing at all to go on? Not even with the illegal time clock procedure? I would like to at least report them to somebody.
