legal questions for wrongfull termination and others?

I was recently fired from what I think might be a business that does some things illegally.

The day I was fired, my manager was going through some stress…she had scheduled only one person for the evening shift on accident, and was having other problems that were causing her to be in a bad mood as she always is.

I was also stressed out, admittedly I had been working 7 days a week 5-7 hours a day, attending college, and am engaged. (worrying about money for the wedding next year.)

That day I had a Panic Attack around 2pm(after my manager had gone home), I have never had a panic attack before, and this one was bad. My fingers were cramped up, my arms, chest, and face were numb.

I had to call an ambulance to come get me, and take me to the hospital. The hospital had a 4 hour wait so I had my mother come get me and stay with me until I calmed down.

The next day, when I went to get my truck from the store (which had been left over night due to the panic attack.) I come in to find out I had been fired.

Her excuse was that I am "scaring customers", and cursing employees.

Now I "KNOW" that there is only one employee that has a problem with me at this job, and I work with him maybe 4 times a month.

I am one of the very few people that work at subway that has never had a customer complaint…The manager…the assistant manager…the night manager…have all had customer complaints.

Yet without warning, I am fired the day after I have a panic attack…now I do admit that I was no-t acting in a polite and decent way this day and the night before, but I was no worse than the manager or assistant manager act on a daily basis.

There are also other things, such as the time clock we use is the cash register, making it impossible for us to clock in sometimes until after we had been there for a while.

What is the solution for this? They go in and manually change our clock in hours to what is showed on the schedule. Which is also wrong because Almost every employee comes in early and has to start working early due to her scheduling to little people.
(I have worked here for the better part of 3 years, I have quit for 3-4 month periods twice in this 3 years due to the anger I had been building up from the constant verbal harrasment, sexual harasment from many employees,(which even after telling my manager, it continued.)

The last straw that is making me consider legal action is the last paycheck I recieved was missing some time…now it was only 15 minutes, but I wrote it on the schedule because I came in 15 minutes early, and my manager came to my truck and had me go to the bank to get change for the store.)

Earlier when I started working there, I had 3 paychecks in a row that I had to go and gett them to change because the general manager left off hours.

Now I dont know if I have a case, but I would like to know what other people think.
So I have nothing at all to go on? Not even with the illegal time clock procedure? I would like to at least report them to somebody.

Has anyone ever experienced how poorly Wal-Mart treats their employees and customers?

I recently watched a documentary on Wal-Mart. It made Wal-Mart look so bad I could barely believe it. The gist of it was that in other countries they make their manufacturers thing pay for rent even if they don’t live there and give them a poor living condition, make their employees clock out but still work over time, are sexist and do not let women advance to management. They also take money from the city they build in somehow and say they have security measures outside the building but the statistics of theft and kidnapping are very high. Has anyone had such a bad experience like this? It is just hard for me to believe they are so evil.

Can people who are in AA get special treatment at work?

If a person is stealing company time or money (small amount) and is involved in alcohol treatment receive different consequences than a non alcoholic employee? There is an employee at my work who is frequently late, no-call/no-show, clocks in without working for up to an hour, is stealing small amounts of merchandise, and is subject for termination. However, when complaints are made, employees are told by management that the "employee" is in treatment and by law they are not allowed to suspend or terminate the individual. Is this the lack of backbone in the company or the law in Massachusetts? Thank you.

Co-Worker Stealing- complicated?

I work in a small gas station owned by 2 guys. One is basically a silent partner- I deal with Bob. The manager is Cindy. She is one of 6 employees. Two employees are related to Cindy, and one recently hired employee, DeeDee, is not related but has been a very close friend of one of Cindy’s relatives (who is also an employee).

DeeDee and I were hired around the same time. She almost always gets more hours than me and I find her extremely annoying. I could ignore that. I recently discovered that she is stealing from the store. I don’t know how much, but its rather obvious to me. Recently when we were closing out the day- she had worked am, me on pm and we ran one shift- I remarked that we should expect the drawer to be short . She reported a . gas drive off in the morning and in the pm a guy got . in gas and realized he forgot his wallet. The drawer came up . over. That is a . discrepancy. She said she must have took money for purchases and forgot to ring them up. Um, forgot? I don’t think so. Its an easy way to steal without it looking like you’re stealing.

Problem is, when I talked to another employee (one related to Cindy) she mentioned how much Cindy likes DeeDee. And Cindy has been managing the store for years.

I know in theory the right thing to do is to report this suspicious activity (oh yeah- DeeDee pads the time clock. I’ve seen this one myself for sure) but I think the only result would be me getting fired.
I know exactly HOW she is stealing but am choosing to not spell out the method here- not everyone here is honest and no sense giving a would-be thief new ideas.

Problem is the way she is doing it there is no way to know for sure exactly how much she’s stealing. When inventory is done the owners will know there is a problem, but not until then.

It sucks the owners are being ripped off. I just don’t see them making the necessary staffing changes to prevent it.

Company versus employee?

My wife work for a company that expects the employees to:

* Clock out AFTER their finish time (Ten minutes in some cases)
* LOSE holidays
* Favour some employees to others
* Refused to reprimand ‘foreign workers’ for fear of the race card, and yet are more than happy to reprimand British workers
* Take THREE MONTHS to approve holiday, any unbooked holiday is lost up to two months before the end of the pay year
* Operate double standards throughout

Without fear of repercussions is there anything I can do?
In answer to a comment below, no they do not get paid for those extra minutes. They are hospital cleaners and are told NOT to leave their wards until their finish time at 4pm, and then they have to walk to the office (ten minutes for the furthest away) and clock out UP TO TEN minutes after their end time – which they don’t get any money for.

They are obligated to work public holidays for which they have no problems whatsoever, except that they then are told they they may lose the days they work (in lieu) unless they book them within a certain time, and when they do they – the dates are usually not available…

How do I get an arrest felony off my record when someone used my name?

i had an ex freind/roommate used my name about 10 years ago when he got arrested for posession of like a pound of weed. He got arrested and bailed out using my name and never showed up for court….imagine that. Well, the court issued an arrest warrant in my name and I almost went to jail over it until they pulled up his mug shot when he was arrested holding up my name under his face. They told me it was a mistake but now my name comes up for a felony posession of marijuanna arrest. How can I have this removed from my record when it was clearly someone else using my name and I believe the police were negligent in obtaining correct identification more than once. Can someone please help me. I don’t have a lot of money and cant afford an attorney.

My manager took 40 minutes out of my pay check, I want my $5…what do I do?

I go to work, clock in, work, clock out, and collect my Employee Clock Out paper after each time I work. I noticed that 40 minutes have been taken out of my last clock out sheet, basically (doing the math) my manager edited my hours and cheated me out of .17 (I work 7.75 per hour). I really just want my money, no matter how small, and besides if I let someone do something one time they’ll do it the next time.

I am 17, and I am a student, I live in NY and according to the New York State Laws (for child labor purposes), I can’t work more than 28 hours, and I would exceed that if my manager didn’t take away 40 minutes due to my shift tonight which will be about 4.5 hours…but I don’t care about my manager or the store, I just want my money that I worked for.

I think they’ve actually broken a lot of new york state laws…because I leave work at 10:30PM on school nights, and ever since school started I’ve worked until then.

I don’t care about the laws I just want my money and I will use the law to obtain my money. Am I right on this? What should I do? Who do I talk to? Can I get more than just my money out of this, and how?

Jail Time for Check Fraud?

I asked this yesterday but didn’t get much answers… I just found out a few days ago that my boyfriend (now ex) stole a bunch of checks from me and used that at a bunch of different places. Well I filed police reports with each city/county that a check was used in. I even have survalence video footage from a liquor store with his face. The total amounts only equal up to be about 0 but I was told that check fraud is a felony. Is that true no matter what the total amount is? I was wondering if anyone knows how long he will have to go to jail for? He has LOTS of priors, none for check fraud, but one is for providing false identification to an officer. Any ideas?
We live in Minnesota. And No I do not want to get back together with him, I want him to pay for what he did. Unfortunetely he will always be in my life because I am 5 months pregnant with his child.
my bank covered all of the stolen money. i get it all back. i am not worried about that. i just want to make sure he doesn’t get away with this. he is a very bad person. he told the places that they were his wife’s checks and that she knew he was using them.

What is your opinion on this situation?

When I came in to work today, I was cleaning some of the paperwork off the desk and came across an application. The application was for night audit with my boss as the referral. Under the application was a piece of paper with the notes: audit (full-time) anytime and 12.50-13.00. I am currently the full time night auditor and we are looking for a part time auditor. Does this sound fishy? What would you think?

It was not on the manager’s desk, it was on the front desk. She has been hiring previous co workers of hers. And I’m pretty sure she doesn’t like me because I often question her about things. (Edits on my time clock, refusing to put money back that I was not responsible for, ect) I have not overstepped my rights or boundries as an employee at any time and she has nothing that I know of against me to actually fire me. Many of the people quit shortly after she was hired because of the way the company/she was treating them and I am the only one left that was hired prior to her arrival.

looking for opinions on this poem i wrote about foster care. Called " damaged goods" thanks ?

We have all read the poem “ A child learns what he lives”

Well here is a story for your mind.

Imagine a large tall building that reaches well into the sky, it spans the size of
several city blocks, It’s stone facade creating shadows on all that
sits in it’s path. Windows that are small covered in bars, dark shades
pulled tight. The title on the Building up so high no one can see.
You get a eerie feeling looking at it’s menacing structure, upon entering it’s
jail like doors you come upon a foyer large and rather plain. The receptionist
looks as if she hasn’t seen the sun in 25 years, her face pelted
with frown lines, so bad that you aren’t sure she has ever smiled.

Walking further down a narrow hall you see a sign plain and brown on the wall
that simply states “showroom —>”. you come upon a large set of double
doors dark and guarded by two men who check your identification and
open the doors, a haunting groan is heard as the doors open.
You enter a large room with shelves in neat rows each labeled
the first one you see says “ babies ages newborn to 12 months , race white or other”
your heart sinks as you feel a sick knotting feeling in the pit of your stomach.
You walk closer and begin to see exactly what the sign described each child
looks healthy and beautiful. But their eyes seem to show their
pain. As you round the first corner you see another shelf with a sign
labeled “ Clearance “ and you see children that are half grown
you see their questioning face knowing they are trying their best to look
the best and be the best deal for your money.

Now that is what the foster care system is like to the children who live in it….

And if some of us children are real lucky we
get a break and find a shopper willing to by damaged goods..
